2. CIPA Compliance and Session Replay Prohibition

Under the California Invasion of Privacy Act (California Penal Code Section 631), recording keystrokes, communications, or visitor navigation without prior consent constitutes unlawful wiretapping. Apex Construction maintains strict technical safeguards:

  • Zero Pre-Consent Tracking: Third-party analytics scripts, marketing pixels, and session replay recorders are blocked by default on initial page load.
  • Explicit Opt-In: Tracking scripts are loaded only after you grant explicit consent via our Cookie Preferences banner.
  • No Keystroke Interception: Form inputs and draft messages are never captured or transmitted until you voluntarily press the submit button.

3. Telephone Consumer Protection Act (TCPA) Communications

When you provide your telephone number through our contact or configuration forms, you provide Prior Express Written Consent (PEWC) for Apex Construction representatives to reach you via phone call or SMS text message solely concerning your building project inquiry. Apex Construction deploys automated firewall rules, rate limiting, and perimeter bot monitoring to safeguard our web infrastructure against malicious attacks, automated scraping, and unauthorized programmatic harvesting. In connection with automated traffic:

  • Non-Human Traffic Classification: Automated scrapers, litigation crawlers, commercial bots, and synthetic testing scripts are classified as non-human traffic. Technical data collected from such requests (including IP address, user-agent string, request frequency, and routing payloads) is processed solely for perimeter defense, forensic logging, and infrastructure security.
  • No Consumer Rights for Programmatic Bots: Because automated crawlers and bots do not represent human natural persons interacting with our construction services, telemetry generated by automated tools is not classified as consumer personal information and does not establish consumer privacy claims.
  • Adherence to Access Rules: All automated traffic must respect standard robots.txt directives and server rate limits. Programmatic harvesting that circumvents security controls is strictly logged and blocked.

5. How We Use Your Information

Information collected is utilized exclusively for legitimate business purposes:

  • To generate accurate architectural estimates and structural feasibility reports.
  • To coordinate site inspections, soil tests, and construction timelines.
  • To safeguard our infrastructure against automated spam, denial of service, and abuse.
